The Art and Science of Constitutional Design


This session is dedicated to the exposition and analysis of the challenges of writing constitutions or major pieces of legislation.  There is a substantive and theoretical element to the mini-curso, as well as a technical/informatics element. On the substantive side, we will review the challenges of writing legislation/constitutions, which include the search and analysis of constitutional models, negotiation, and collective drafting.  On the technical side, we will identify some cutting-edge computational methods and tools that help overcome these challenges.  The point is to illuminate some of the pragmatic concerns of decision-makers, and to identify a productive set of research questions and designs for studying, and assisting with, constitutional design.
